REGULAR MEETING                                                                                                     August 6, 2007
TOWN OFFICE BUILDING                                                                                                     6:30 p.m.


Selectman Patton called the meeting to order at 6:30 P.M. with the following in attendance:  Selectman  Lewis, L. Nicholls, and residents.  Selectman Patton led the Pledge of Allegiance.


Approval of Minutes

SELECTMAN LEWIS MOVED TO APPROVE THE MINUTES OF 7/16/07.  
Selectman Patton seconded the motion.
VOTE:  2 YES (PATTON& LEWIS)    0  NO

SELECTMAN LEWIS MOVED TO APPROVE THE MINUTES OF 7/23/07.

Selectman Lewis wanted additional information in the minutes of July 30, 2007 regarding the use of the Transfer Station Building.  He had gone to the Transfer Station and there were customers in the lot.  The employees sat in the building until he got there and then came out.  The employees had been asked in the past to have a least one of them out helping the customers.  Haulers have complained also.  The employees should be out there supervising.  We need to limit the use of the building.  This is not a place to just sit and watch what is going on.

Present to Speak

Mike Makuch, Chief of the Willington Hill Fire Department, presented a letter (attached) regarding the Tinkerville Road closure and the procedure that would take place for any emergency from 103 Tinkerville Road to the Ashford line.

Mike reported that there are grants in place for certifications for training.  The training school schedule is out—they will re reimbursed for half of the training fee.  Willington Hill is also working on a couple of other grant applications.




Correspondence

A list of correspondence was available at the meeting and in the Selectman’s office.  A letter from Lucien Bessette was read and put into the record.

Public Works

Lynn Nicholls reported that the Tinkerville Road project started today—the signs are up.  Signs throughout town have been damaged and destroyed—this is quite an expense to the town.  Off-road vehicles and quads are all over—we need more police presence.  The machines are digging up the roads; there is no respect for other people’s property.  It would be good if the townspeople would call Troop C to report vehicle activity—these quads etc. do not have plate numbers to report.

Lynn asked permission to get an estimate for the repair of the wall in back of the Town Office Building.  Selectman Patton gave Lynn permission to get an estimate.  They may have to mortar it in but they hate to do that.  The wall is getting worse.

They are working the chip seal route—drainage on Meadow Lane, Daleville School Road, and Daleville Road and doing all the washouts. The backhoe is down and must go to Lif-tec; it was fine at the beginning of the day when the hydraulics were cool but by the end of the day it needed repair. A rental was used today.

Karl Acimovic and Lynn are working on a write-up and getting prices for labor and materials by road.

The progress of GASB was discussed.  

Selectman Patton motioned to adopt the Kechkes Road Bridge Committee RECOMMENDATION, WHICH is to direct the Town Engineer to complete the engineering drawings for a 15’ wide bridge over the Fenton River.

A.  Resolution
     Selectman Patton read the following resolution.







Resolution
“Electronic Voting Equipment Agreement”



WHEREAS, the Help America Vote Act of 2002 has developed a uniform set of requirements for each voting system used in an election for federal office;

WHEREAS, the Election Assistance Commission has determined that lever voting machines are not compliant with the requirements of the Help America Vote Act;

WHEREAS, the Office of the Secretary of the State of Connecticut has used federal funds advanced through the Help America Vote Act to purchase voting machines in compliance with this law, these being the “LHS optical scan voting machines”;

WHEREAS, the Town of WILLINGTON is a municipality in the State of Connecticut;

WHEREAS, the Town of WILLINGTON, through its elected officials and the employees thereof, is responsible for conducting primaries and elections, federal and otherwise, within its borders;

WHEREAS, the Town of WILLINGTON through its Board of Selectmen is responsible for providing suitable voting machines for use within its own municipality;

THEREFORE, the Board of Selectmen of the Town of WILLINGTON hereby accepts ownership of the said “LHS optical scan voting machines” and will begin to use said voting machines with the first election of November, 2007.

Selectman Patton motioned to accept the Resolution for Electronic Voting Equipment Agreement.

B.  Tax Refunds

Selectman Patton motioned to refund $337.98 to DCFS Trust of West Lake Texas for their 2005 Jeep Grand Cherokee station wagon—the reason was that they moved.
Selectman Lewis seconded.  VOTE: (2 yes  Patton & Lewis) 0 no.

Selectman Patton motioned to refund an excess payment of $1197.42 to Countrywide Tax Service, 7105 Corporate Drive, Plano, TX for the Grand List of 2005.
Selectman Lewis seconded.  VOTE: (2 yes  Patton & Lewis) 0 no.

Selectman Patton motioned to refund $56.74 to Kathleen Pepin of 42 Laurel Drive, Willington, a refund credit for a vehicle sold, destroyed, stolen and not replaced or registered in another state; a Ford F150 pickup.
Selectman Lewis seconded.  VOTE: (2 yes  Patton & Lewis) 0 no.

Selectman Patton motioned to refund $14.78 to Charles Wiggins of 222 Willington Hill Rd. Willington
for a vehicle sold, destroyed, stolen and not replaced or registered in another state; a 1991 Chevy.
Selectman Lewis seconded.  VOTE: (2 yes  Patton & Lewis) 0 no.

Selectman Patton motioned to refund $152.10 to Brian or Spencer Frazee of 88 Glenn Drive, Tolland CT
a refund credit for a vehicle sold, destroyed, stolen and not replaced or registered in another state, a  2001 Honda Civic.
Selectman Lewis seconded.  VOTE: (2 yes  Patton & Lewis) 0 no.

Selectman Patton motioned to refund $139.18 to U S Bank of North America a refund credit for a vehicle sold, destroyed, stolen and not replaced or registered in another state, on the Grand List of 2006, a 2002 Xterra moved out of state.
Selectman Lewis seconded.  VOTE: (2 yes  Patton & Lewis) 0 no.

C.  Subordination Request

A taxpayer approached the Selectmen to subordinate his rehab lien so that he could get a mortgage to complete construction.  He did not fall within the guidelines.  Selectman Patton reviewed with the taxpayer why he did not quality but noted if the taxpayer had additional information he can be put on the agenda for Thursday that the selectman will review the additional data at that time
.

Good and Welfare

Lynn Nicholls reported that Bob and Judy Campbell had been interviewed by Channel 3, WFSB for their part in rescuing labs lost during Hurricane Katrina.  Judy rescues Ridgebacks also.  Both Selectmen congratulated the Campbell’s.
